Consumer Advocacy Group Joins Forces with Law Firm

Consumer Advocacy Group Joins Forces with Law Firm
North Huntington, PA (PRWEB) May 23, 2005
The United Consumers Advocacy Network (UCAN) announced today an alliance with Apex Law Group and its national network of attorneys to offer legal support to clients of debt relief companies that subscribe to UCANÂÂs services.
The alliance will offer a broader range of services ranging from basic advocacy to legal representation in court if a client is sued by a creditor or if a creditor violates a clientÂÂs consumer rights. Apex will also offer bankruptcy solutions to clients whose financial situation worsens and are unable to continue their debt relief program.
UCAN executive Dave Leuthold says that there is a growing need to protect consumers enrolled in debt relief programs against abusive collection practices and creditor lawsuits.
ÂÂAs a third-party advocacy firm, creditors are usually willing to work with us once we get involved in a case,ÂÂ explains Leuthold. ÂÂHowever, cases do arise that necessitate legal intervention and this new alliance gives us greater access to attorneys to safeguard clients from lawsuits and violations of consumer protection laws, such as the FDCPA.ÂÂ
The Fair Debt Collection Practices Act (FDCPA) was passed in 1977 because of the tremendous volume of complaints the Federal Trade Commission received from consumers and consumer advocacy groups about unethical debt collection practices. Violations can be costly for debt collectors as each carries a potential $ 1,000 civil penalty in addition to actual damages suffered by the consumer. A class action lawsuit for FDCPA violations could cost a collection agency up to half a million dollars.
ÂÂClients of debt relief companies can barely afford to repay their debts, much less an attorney to defend against creditor-initiated lawsuits,ÂÂ explains Dharma Naik, lead consumer rights attorney for Apex. ÂÂThis alliance provides legal assistance to clients who would otherwise fall victim to default judgments because they simply did not have access to an affordable attorney.ÂÂ
UCAN services are available to clients of debt relief agencies who subscribe to UCANÂÂs services.
About UCAN: The United Consumer Advocacy Network was formed in 2001 by experienced industry veterans to offer advocacy support and services for clients of debt relief agencies. UCAN serves the needs of debt relief companies and their clients as they face the growing problem of abusive, harassing and unfair practices of creditors and their collection efforts. For more information, please call 1-877-462-UCAN or visit their website at http://www.ucan.net.

Is a Debt Relief Order the New Bankruptcy Option?
Filed Under Medical Bills Assistance | Leave a Comment
Is a Debt Relief Order the New Bankruptcy Option?
It is and should be the last option that you consider if you are in a real crisis where debt is concerned.
Bankruptcy is a very serious issue which has some adverse consequences which can make life difficult although it will ease your debt problems to a degree.
However, since April 2009, an alternative to bankruptcy has been available to those who have previously only considered Bankruptcy but either couldn’t afford the £450 fee just to apply for bankruptcy or who still wouldn’t be able to keep up with the payment arrangements under the Bankruptcy order.
The alternative is called a ‘DRO’ which stands for ‘Debt Reduction Order’. But this new DRO has been met with criticism by some people who claim that they now make bankruptcy an all too easy option. While this is true to a certain extent, a Debt Reduction Order really could be the solution for some people.
However, there are much stricter criteria to qualify for a DRO than there is for bankruptcy.
To qualify for a Debt Reduction Order you must have debts in excess of £15,000 yet your total assets cannot be worth more than £300 which means that home owners will not qualify due to the value of their house which is taken in to account as an asset.
Also, you must have a disposable income of £50 per month or less which is an incredibly low amount.
As you can see, a DRO is really designed to help those who have no real chance of ever being able to repay their debts which are leaving them with no money to live on each month.
You must realise that a Debt Relief Order is actually a form of insolvency, similar to bankruptcy, which means that the details of the order will be publicly displayed on the Insolvency Service website. The details of your DRO will be publicly displayed on the Insolvency website making it public knowledge.
The only way that you can apply for a DRO is via the services of organizations such as the Citizens Advice Bureau. Using the information on your application form they will decide if you do qualify for a (DRO) Debt Relief Order.
The Official Receiver will then review and administer the application. If they agree that your application meets all of the requirements they will accept it without any involvement of a court. But be advised, if the Official Receiver finds out at a later date that the information you supplied is inaccurate, then they may revoke the Debt Relief Order. This would also mean that you could not reapply for another DRO for a period of six years.
Further details about applying for a Debt Relief Order can be found at http://ukcreditsecrets.co.uk/blog/debt-relief-orders/debt-relief-orders-what-is-a-debt-relief-order/ where there is a full list of resources and further information to help you in deciding if a DRO is right for you.

Tax debt relief www.taxreliefadvisors.com is opted for by people who have somehow failed to file their returns, which in result have made them liable to pay a repayment of back taxes. This is no doubt a severe and frightening state of affairs. This may occur due to various reasons. It might be an emergency such as individual or family illness, death in a family, change in economic condition, and lack of budgeting or lavish lifestyle. In these situations failure to pay the money or underpayment are the two most common things to happen. And if this thing really occurs one should fix it as early as possible that is because some forms of non-payment are liable to be punished by imprisonment for every year of taxes that has not been paid.

Franklin Debt Relief Warns Consumers About “Obama Government Credit Card Debt Bailout Letters”
(PRWEB) April 19, 2010
Marketing companies and disreputable debt relief companies continue to find new and innovative ways to deceive consumers to use their services. The latest method â direct mail to consumers from the âNational Debt Relief Divisionâ â is duping people into the idea that, thanks to President Obamaâs economic stimulus package, consumers with more than $ 10,000 in credit card debt are eligible for substantial reductions in the principal amounts they owe.
âThese companies are trying to take advantage of widespread misperceptions about the nature of the stimulus. Most of the consumers weâre talking to are smart enough to realize what is going on, but I fear their may be other consumers who are falling for this stuff,â Franklin Debt Relief CEO, Robert Zangrilli warns.
At a time when debt settlement companies are coming under attack by regulators and lawmakers, Zangrilli says these ads are affecting both consumers and the debt settlement industry as a whole negatively. âThis is another example of the bad actors within our industry grabbing a lot of attention. Most of the companies in the industry are committed to providing a useful service for consumers in need. Unfortunately, there is a small but highly noticed group of companies doing harm to consumers.â
If you are a consumer who has received a letter purporting to offer a service as part of the ânational debt relief stimulus,â report the ad to The Association of Settlement Companies (TASC), who is taking action against these types of campaigns. Consumers who are interested in learning about whether they can qualify for a debt reduction program should contact a reliable debt settlement company approved by a trade group like TASC, such as Franklin Debt Relief. A reputable organization will accurately disclose the nature of the service being offered, including potential risks and effects of settling your debts for less than the amount owed.
Consumers can reach Franklin Debt Relief at (877) 274-1260 or by submitting a form at http://www.franklindebtrelief.com. Franklin Debt Relief is a leading debt settlement company headquartered in Chicago, Illinois. Since 2007 Franklin has helped more than a thousand consumers with their “New Deal” debt relief program.

Fast lives and super fast expenditure, the entire track record of all purchases and sales are stored in micro chips with the leading credit card issuing banks as their consumers get more and more financially indebted to them.
For any middle class individual, the statements and bills received at the end of a fiscal year is the biggest liability as in most cases the individuals lose track of the expenditure they make all throughout the year. Therefore, the most common occurrence in society today is the cases of personal debt that needs legal assistance in order to be cleared.
Debt relief is a condition where in a person who has been found to default high amounts in debt, the nature of which he cannot clear given his present financial conditions, applies for legal guidance and assistance with the aid of a debt relief lawyer who helps him petition for extra duration in repay of loan or clearance of debt.

It therefore, comes as no surprise that the number of cases registering for debt relief is on a steady rise and more and more Americans are becoming a victim of the reckless financial conditions rampant in the society today.
There are many companies in the market that offer services of debt consolidation which have been found to be more in the interests of the companies rather than that of the debtor. These companies use effective marketing tools to lure debtors into situations more hazardous than their current conditions.
It is therefore, advisable that every individual who is faced with the situation of personal debt should hire a debt relief lawyer who will help them attain the correct legal procedure to clear their debts. The most important option availed by most citizens today is the petition for the condition of bankruptcy. The debt relief lawyer or the bankruptcy lawyer helps file a petition under the Chapter 7 or 13 of the Bankruptcy Code.
According to the chapter that the case files under, the appropriate course of financial relief is extended to the debtor. The entire procedure is the responsibility of the debt relief lawyer. The Simple Idea That Could Revolutionize Debt Relief

The Simple Idea That Could Revolutionize Debt Relief
It is truly incredible how progress occurs. One seemingly small idea can change the entire world and the direction of its habitants’ lives. Not every breakthrough is as revolutionary as the printing press or the internet, but nonetheless, their impacts can be profound. One such revolution may have just occured in the debt relief industry.
Traditionally, consumers that are severely indebted have had three bankruptcy alternatives to choose from: credit counseling, debt consolidation, and debt settlement. The revolution that is potentially on the horizon could mean the end of all three; and it’s all because of an innovative new program called “debt restructure.” Essentially, this is because debt restructure offers consumers the upside of the three traditional programs which consumers previously had to choose between.
Credit counseling and debt consolidation are often elected by consumers because they make monthly payments more manageable and inflict limited damage on credit ratings. The downside is that the debts still carry a sometimes overwhelming burden that can persist for decades. On the other hand, consumers might choose debt settlement because it offers the advantage of significantly reducing a debt, and allowing it to be paid off in a matter of years. While attractive, debt settlement turns away many consumers due to the credit damage endured throughout program enrollment.
The debt restructure program allegedly offers the best of both worlds. Like debt settlement, debt restructure involves the negotiation of debt with a consumer’s creditors. The only real difference in the two programs can be found in the negotiation process. In debt settlement, the consumer refrains from making payments on their debt until enough money is saved to offer as a settlement. It usually takes a few years to save enough money, and it is during this time that the severe damage to credit scores is dealt. Debt restructure has circumvented this prolonged period of non-payment with the introduction of what is called a “debt buyer.”
The debt buyer is a third party investor that agrees to purchase the consumer’s debt from the creditor at a settled rate soon after enrollment in the program. The consumer than makes monthly payments to the investor until the settled debt is paid off. Under this process, the consumer’s debt is not only significantly reduced, but there’s no proloned period of credit score damaging non-payment. Ultimately, this means that the debt restructure program has combined both advantages of the traditional debt relief services, while adding no new risks or hazards.
Since debt restructure is still in its infancy, it’s impossible to tell how effective it will be, and whether it will have the success that is anticipated. On paper, however, it looks like the program will inevitably absorb a majority market share from the existing debt relief services, and possibly even push them out of viability. In any event, the program is certain to have a significant impact on the debt relief industry and the consumers that seek it’s solutions.
